I purchased an XTS3500 from watchbuddy on ebay aka Nick Deluca back in June of '02. I received the radio shortly thereafter and it was as advertised. Several months later, I realized that I really didn't need it that much after all, so I sold it to a guy at the TRW swapmeet here in El Segundo. End of story, right??
WRONG!!!
Now, almost 3 years later, I get a letter from Motorola, saying that I am "instructed" to send the radio to Motorola immediately, with NO mention of compensation for the $1300 I spent for it, although they did offer to pay for shipping.
There are also some other statements in the letter that can only be described as pure fantasy, such as "Your continued use of the radio could threaten personal and public safety" and "The continued use of an illegal, counterfeit radio by you, or a third party you may have subsequently sold it to, is illegal and unauthorized by Motorola, the FCC, and/or Industry Canada. Further, since the radio was not built, tuned or tested to Motorola and FCC/Canada specifications, it could malfunction at any time causing interference with Public Safety Agency operations and endangering personal and public safety. Accordingly, we instruct the immediate shipment to Motorola of all ASTRO Saber III, and/or XTS series radios you have purchased from Mr Deluca."
Either Motorola thinks I'm a complete idiot, or perhaps they actually believe this nonsense. Either way, I think this letter is really inappropriate. They also threaten legal action if I DON'T send them the radio, and here's MY favorite part:
"If you sold the radio prior to receiving this notice from Motorola, it is YOUR responsibility to contact your buyer, explain the situation and work with them to ship the radio to Motorola using the procedure explained in the previous paragraph. The Motorola agent will also require you to supply Motorola with your buyer's contact information."
I think they've gone nuts. What authority do they have to instruct a private citizen to send personal property to them, without compensation??
I'm not concerned because I don't have the radio anymore nor do I have the info on the guy I sold it to, but if I did, I certainly wouldn't throw $1300 away just because the big M "instructs" me to....
I think the contents of this letter may be of interest to some here on Batlabs, so I scanned the letter into JPG format but I can't figure out how to post it in this message.... any hints??
