OT: Credit Card Chargebacks

Sorry for the off topic post, but I believe some of you here have experience with this. This purchase was for tower climbing saftey gear (so its somewhat close to topic :) )

I did a search for the word "chargeback" on here, but could not find specifically what I was looking for. I know that if a customer is not happy with a purchase made by credit card, he/she can request a chargeback from their bank which gets deducted from the seller. I ordered something off ebay, paid by paypal with cc, but never got my stuff. I am waiting for paypal to refund my money, but I originally tried to file a chargeback instead (as they are *supposed* to be much faster)

The CS rep didn't even know what the word "chargeback" was. I had to explain that it is when a buyer disputes a charge for a purchase. She finally *sorta* understood what I meant, but said that it takes 45 days to process. I tried to find some Federal Law covering the rights of CC holders on chargebacks. Closest thing I could find is as long as the seller is within your state, or within 100 miles of your home then you can file for a chargeback. Can anyone give me some pointers, or the Federal Law regarding chargebacks from Internet purchases? The seller is in the US, but is more than 100 miles from me. My CC bank doesn't seem to be familar with the process or the laws that govern it.

I can definitely comment on this one!

A friend of mine got in the same situation as you, however, his credit card company did aparently know what to do and they did a chargback.

The problem however is that when you pay someone through paypal with a credit card your paying paypal first then they pay the seller. So when you issue a chargeback through the credit card company paypal gets pissed because they think you are trying to rip them off.

The person that i know that did this had his paypal account frozen because of the chargeback, he then had to go through a bunch of paperwork, email, phone calls, etc etc, to get his account accessible again. They froze his account with a large sum of money in it and denied him access to those funds until everything was straightened out a month later.

Your best bet is to just go through normal due process with paypal first, if something happens and they will not refund the purchase price, minus fees of course, then go after them with the credit card company backing you up.

I sucks when this stuff happens - I know - however it's not something for discussion here.
