SCADA on a conventional digital system

We are using a M conventional 400 MHz digital system for both voice and MDT data using a Quantar base and Astro Spectra mobile radios. The system is 10 years old so I think this may be called first generation equipment because of the speed it is running. I think it is 4800. The system is not very busy. One of our SCADA engineers asked if we could temporarily run 1 SCADA site over this system until the phone line can be installed. The SCADA is polled 1 time in a minute. An outgoing poll lasts 2 seconds and the response is 2 incoming data messages of 2 seconds each. My initial thoughts were since the remote scada site is fixed, that his would be prohibited by the FCC. Is anyone running a similar situation? Does this even sound like it may be possible to do?
