MURS ERP

Like a lot of folks, I'm glad that the 2 154 Mhz MURS freq's are staying wideband so my 2 HT600's can be used for non-ham use too with car to car road trips in mind. When I mentioned the 5 watt output to my buddy who works for Moto, he told me that the FCC had made a change to the ERP of MURS at some point effectively creating a loophole which while not directly saying 5 watts is OK, but, it does make enough of a gray area so you are allowed to use them as the ERP allowed is something like 10 to 20 watts through gain. He also says that with Duck antennas you really aren't putting out much more than 2 watts anyway. It makes sense to me. Anyone have a take on this for the sake of discussion?
