Okay, so I admit that I was recklessly bidding on the XTS3500 just to see what would happen. I figured I would be outbid and I was right. While the auction was ongoing I asked the seller to send me the flashcode along with the correct pictures of the back. (Desire to see FCC ID #.) Any who what I got back was the following email:

So it looks like from what I can decipher he wants to have me buy at least three (3) but up to twenty (20) XTS3500's at $555.99 USD and he will give me one (1) to five (5) Samsung E700 cell phones. I was actually going to inform ebay of the solicitation in case it was in violation of their rules. He also misrepresented himself in his location. The link on his email was to a Tiawan Ebay site while his auction says "Small town USA". I guess it is true what they say... Buyer Be Ware!!

ROF Thanks for the heads up! I kind of already figured this out. I have bought and sold several radio items on eBay and have yet to get burned. It is definently a dangerous road to travel if you cannot spot the pitfalls. I emailed medic646 the current high bidder of the auction to let him know what has happened to me. Hopefully he can adjust his bidding strategy so he does not get burned.
It is really too bad that there are people out there like this. I am still considering contacting eBay about this matter. I don't think it is right for eBayers to misrepresent themselves in any way.
As a I side note I just wanted to thank you for all your great posts to this board. Being some one who always likes to learn new things you provide a wealth of useful information. Although you and I have not interacted on any specific matters you have still taught me a great deal. As I work my way into newer more advaced radios I may be soliciting you help/advice.

Radio aside for a minute... looking at the history and feedback I see someone who has made a lot of buys and sales for some time and held the same name also... I think you are confusing an unsolicited email which was obtained by an outside party with the actual seller on ebay... He got your name and contact because you bid...... I don't know how many hours since you requested the info from the seller, but it may be that he just hasn't responded yet .... The person who sent you the email is most likely not the seller... This has been an ongoing thing for sometime...not just on EBAY but on other sites where people list contact info. As to the radio I agree with ROF , you don't want a 3500... but this sounds like a radio being sold by someone who just doesn't know much about it..hence the generic copy the moto ad.. However the last 10 digits of the model number are actually a serial number which indicated built in 2000, January... a call could probably verify the rest... I also think the scratched screen is an issue that I would be concerned with... I am not saying that this isn't kinda of screwy but see if you actually get a response tonite / tomorrow from the seller and then do some back tracking... ie IP addresses etc ..email info...I think you will have two different sets of info... your scammer and another person on ebay whose got a radio and doesn't know much about it..

i read it the same way 1 Adam...
never fails, these scammers look for exclusive high end items and start emailing the bidders of the item.
most likely, i think you are dead on that he was spoofed with an email from a scammer - NOT the actual seller.
for the reason above, all of my ebay auctions from now on will be private auctions.... not to even mention the wierdo's who cull the lists of bidders on items and have the nerve to attempt the sell the same item at a lower price to one of your bidders.
screw 'em - no more of that with private auctions!
