Motorola Not Allowing RSS Puchase

I recently began to maintain a fleet of radios, HT750, 1250 and CDM1250, 1550. There are about 380 radios total and Motorola will not allow for the customer to purchase the professional Series RSS, instead they want the customer to take the radios to a Motorola Dealer for programming. Is this legal. The customer cancelled service with the local MSS for lack of service.

That's what they get for choosing /\/\ I wonder if /\/\ will notice when they have very few customers in the future, atleast those that are not stuck with a /\/\ system

This is a well known issue with the HT/CDM series CPS, and is literally mentioned in hundreds of threads here. Is it legal? I'm sure in at least some jurisdictions it isn't. You'd need to discuss with a lawyer in your area. Will that help? Put it this way...that CPS has been around for 9 or 10 years now, and I've never heard of a successful lawsuit against Motorola forcing them to provide it to an end user.

Keep calling Motorola and do it every day until they tell you to stop. Depending on who you get on the other line depends on what you may be able to get.

You need to call the local Motorola shop and find out who
the regional Motorola manager is and how to contact that
person. Then start your quest from that point.

You can prevail, but you need to be polite and play the
game as Motorola makes you jump through the hoops.

i work for a motorola shop and we sell the cps everyday. all motorola needs is the end user.

I doubt it. There are lots of people here on the board that work for a MSS shop and they don't sell it. The only legal place to get CPS is from Motorola

not only can't local shops sell the rss/cps, even if we were to sell somebody 100 radios, our opinion to motorola is meaningless if we even recommend they sell them the software. if you guys are selling it i wouldn't be announcing it, you'll be out of business real soon.

You won't be a dealer for long if Motorola finds out you are doing this. We are a dealer as well, and cannot re-sell the software. Nobody can, it's only legally available from Motorola directly. Check your RSS/CPS licensing agreements.

Depending on who you are maintaining the radios for, it may help you to aquire the software from Motorola. If it is a public agency, I'd suggest you have them apply for the software license and then you use it to program the radios. Yes it may cut into your profit a bit, but it may work...

Ok here is the scoop,

Motorola can not legally prohibit the sale of RSS to any person who owns or operates Motorola Radios. Professional series included, They can not legally restrict software sales on a selective basis. This came back from our Attorney who had contacted Motorola Legal. However a little to late now, the customer has switched all equipment to ICOM and is very pleased, I now am the owner of several hundred Profesional Series radios.

Your scoop has about as much credibility as your claim of a tri-band XTL.

I suspect the customer either left out some required information or answered one or more questions incorrectly on the restricted SLA application, causing /\/\ to deny the application.
