It should have a certificate on it's label stating that it is FM approved.

Look on the Very Bottom of the Radio, should have a Green FM Approval sticker there. To make a true Intrinsically safe radio you have to have a Intrinsically safe battery too. That too will have a green label on it.

The only way to know that a radio is intrinsically safe is if you:
Purchased the radio new from Motorola, certified IS
Have records of all service performed on the radio, performed at a Factory Mutual-certified shop
Have never opened the radio on your own
If you have a real need for intrinsically safe radios, you should have this paper trail. If you don't, you should NEVER attempt to use the radio in an atmosphere that requires intrinsically safe operation.
Think of it like a submersible radio. Unless you bought it new, had Moto do the maintenance, etc., you don't know for certain that the radio is still submersible. Same deal with IS.
Purchased the radio new from Motorola, certified IS

If that is the same one you have for sale I would suggest you inform the buyer of what Terry has stated. You certainly don't want that comming back to bite you in the butt later if something were to happen.

I don't see any problem with the way he has this radio listed for sale. This seller is not claiming this to be an IS certified model... Neither his post here on the board nor his eBay listing makes any mention that this HT750 might be FM approved or IS. Anybody who is interested in buying his radio the way he has worded his listings would be a gambler or a fool to ASSUME it's intrinsically safe.

He just said in a previous post that someone had asked him. I am assuming it was a buyer, if he tells them " why yes it is"...... I'm sure you see the bigger picture in a now sue happy world. It was just a bit of advise, I'm not jumping him over it......

i don't think anyone that would actually need an IS radio buy it used off of ebay or anywhere else, they are gonna want to be 100% shure and take it out of the box new themselves.

The radios, for the most part, are indeed identical. Some will have minor differences (different gasket, different switch), but most have no physical differences. The big difference is that the radio is tested and certified by Motorola (and backed by a very large insurance policy, most likely) to be intrinsically safe in certain environments. You're paying for testing and insurance. Also, sometimes, certain accessories are restricted - one speaker mic might be IS, another might not).
Same idea as TSOed radios for aircraft (same radio, you're paying for certification and insurance), NFPA compliance for firefighting equipment (certification and insurance), etc.
Furthermore, the radio must be maintained by a Factory Mutual approved shop, and a paper trail of its purchase, service record, etc. be maintained.
Many/most users don't need FM certification and won't maintain the paper trail anyway. So why should they pay for it?
If you aren't a dealer, selling a brand new radio, and aware of all the issues, do *not* market any radio as being intrinsically safe, even if it has the labels.

More for the record.
1. Yes radio must originally purchase from Motorola IS. (this is tracked in thery DB however things get lost easily even electronically)
2. Radio should have always been LAST (keyword last) serviced by an IS certified Motorola shop (I can only think of one outside of the motorola Depot)
3. The sticker must be on the radio (little green sticker that states FM safe and list of proper batteries)
4. Most importantly is the battery as this is what truely makes the radio IS. All parts from motorola are the same IS and nonIS radios do not have different parts. Covers are all nonstatic plastic etc. However I would NEVER, EVER, NEVER take a nonIS radio into an IS environment even if I had an IS battery on it. I've even black listed radios here that weren't IS going back to a customer I knew was supposed to be IS.
