NO LICENSE REQUIRED?
I have gotten some very good information from fellow batlabbers in the past, so here's my question. I need to find in the CFR or in the FCC rules, whether I need to license a radio frequency which is going to be used underground and does not radiate outside a tunnel. I remember going through this about 20 years ago with NYCTA and their use of some vacated NYPD frequencies. The coordinator sent the NYCTA a letter stating that since the signals were not going to be radiated above ground, frequency coodination and licenseing were not required. Related to this was a problem that later popped up when a PD in New Jersey licensed on those very same channels, causing interference in both systems, which cost the City about 100K to fix.

If someone operating within their license parameters "above ground" caused interference on an underground system and vice versa, doesn't that say that the underground system emitted radiation above ground level? If that's true, then the underground system probably should have been licensed.

Well I wasn't going to get into the specifics, but the NYCTA in their infinitly small wisdom, decided to use the same frequencies above ground. Between the time the started using them and the licensing process, those channels were reassigned to a Parks Police Dept in New Jersey. Then it came down to who was on the channel first and so on and so on.
