OT Help programming vertex vx3000

was wondering if any one out there is having this problem, the rss program comes up (by the way I am using ce19d ver 4.4) when I tell it to upload(read the radio) it then ask if you want to upload click on ok I do and it says waiting, the radio says clon but that is all that happens.
I am some what familiar with vertex I have a vx-10, vx160, and a vx180 and this computer has no issues with them what so ever I am using a dell Laptop at 100mhz I even modified a moto rib box from the info from bat labs and it is doing the exact same thing so I know the cables are ok.
This is a radio I bought off ebay and the owner of it says it programs fine, he is even willing to take it back and relist it, he seems to think it is user error on my part. And I am begining to think he might be right.
any and all help would be appriciated.
